2. MODALITIES
On the day of the drawing, at the time of the draws, a number of entry tickets specified by the respective casino will be drawn to determine the finalists for the subsequent game. The drawn entry tickets will be checked for validity and are valid only for the drawings on the aforementioned day of the drawing. Invalid entry tickets will be immediately discarded, and a new drawing will take place.
The first and last name visible on the drawn entry ticket will be announced in the casino via a public address announcement. Entry tickets that have already been drawn will not be returned to the raffle box. The person called must report to the location of the drawing within the time announced via the public address system and present identification. If the announced person does not appear, a new draw will take place.
Unless otherwise announced, the game begins immediately after the final draw. The game may vary depending on the casino and is a game of chance. The following variations are possible, such as: The finalists roll dice, draw a card, pull a string with a number attached to it and hidden beforehand, spin the wheel of fortune, drop a ball into the roulette wheel, flip a coin, or similar. The highest number, card, or similar determines the prize. In the event of a tie, a tiebreaker will decide. The order in which prizes are awarded is at the casino’s discretion.
3. ELIGIBILITY
The prerequisites for participating in the prize game and participants’ entitlement to collect prize winnings are membership in the Casinos Austria Members Club, the fact that the recipient is RED level on the date of the RED Members Day, and presentation of the barcode from our newsletter mailing.
The prizes stored on the digital wheel of fortune will only be awarded while stocks last. Once all prizes have been won, there is no entitlement to participate or win.
Employees of Casinos Austria AG and Cuisino GmbH, as well as any associates involved in the promotion, are not eligible to participate. The casino management makes the final decision regarding all aspects of the prize draw, in particular with regard to eligibility to participate, the validity of the entry cards and the prize draw procedure. Recourse to courts of law is excluded.
Casinos Austria AG reserves the right to discontinue or terminate the promotion within the promotion period without stating reasons or to exclude participants from the game, in particular in the event of a violation of these terms and conditions of participation.
We would like to point out that legal or official regulations to prevent the spread of diseases (e.g. COVID-19, etc.) may come into force during the promotion period, which may completely prohibit the promotion from taking place during the promotion period, make participation unreasonably difficult for casino visitors or make adjustments or postponements necessary. Should Casinos Austria AG be prevented from carrying out the promotion due to force majeure, these terms and conditions of participation will be unilaterally adapted. Force majeure includes, but is not limited to, the impossibility of implementing the promotion due to legal or official orders or exceptional natural events such as epidemics or pandemics (e.g. COVID-19).
Should any provision or part of a provision of the terms and conditions of participation be found to be invalid, this shall not affect the validity of the remaining provisions and the terms and conditions of participation. Austrian law governs exclusively with respect to the implementation of the promotion, to the exclusion of the UN Convention on Contracts for the International Sale of Goods and Austrian conflict of law rules.
4. LIABILITY
The liability of Casinos Austria AG and its executive bodies, employees and vicarious agents arising from or in connection with the promotion, regardless of the legal basis thereof, is limited to cases of intentional acts or omissions and gross negligence, with the exception of personal injury. Casinos Austria AG accepts no liability for lost chances of winning.
5. PRIVACY NOTICE
Casinos Austria AG processes the following personal data solely in line with all applicable national and European data protection regulations. Casinos Austria AG processes the personal data of participants as described in the sections “Modalities” and “Eligibility” above for the purpose of implementing and processing this promotion and ensuring compliance with the terms and conditions of participation. This includes, in particular, the contact details required to notify the winner and, in individual cases, additional information such as information on the issuing of entry cards, visits to the casino and membership in the Casinos Austria Members Club, to the extent this is required for operating the prize game in accordance with these terms and conditions of participation as described above. The processing of personal data is based on Art. 6 (1)(b) of the GDPR (performance of a contract).
Personal data is processed for as long as is absolutely necessary to fulfil the purposes for which it is required. Any further storage may result from legal obligations or any pending administrative or judicial proceedings.
